The purpose of this paper is to explain the definition, the way to master, the advantages, and all about critical thinking. The specific purpose of teaching this critical thinking in science or in other discipline is to improve the skills of someones thinking for better prepared to succeed in the world.And then the critical thinker is someone who can use or even master critical thinking. They can think critically and creatively, to distinguish between facts and opinions, ask questions, make detailed observations, uncovering assumptions and define their terms, and make statements based on logic sound and solid evidence. The ideal critical thinker has a sense of great curiosity, Actual, his reason can be trusted, open minded, flexible, balanced in the evaluation, honest in facing personal prejudices, be careful in making decisions, willing to reconsider, the issue of transparency, smart in finding relevant information, reasonable in choosing the criteria, the focus in inquiry, and persistent in seeking discovery. In the form of simple, critical thinking is based on the values of the universal intellectual, namely: clarity, accur acy, precision (precision), consistency, relevance, the facts are reliable, for reasons good, deep, broad, and according to (Scriven and Paul, 2007). CHARACTERISTICS OF CRITICAL THINKER To find the people who have the ability of critical thinking, there are 27 characteristics of critical thinking developed by Ennis (in Costa, 1985), namely: (1) They are looking for a clear question and a question of theory;(2) they are looking for a reason; (3) they are trying to be an Actual; (4) they are using the resources that can be trusted and express; (5) they explain the entire situation; (6) they are trying to stay relevant with the main idea; (7) they are keeping the basic and original idea in the mind;(8) they are looking for an alternative; (9) they are open-minded; (10) they are taking a position (and change the position) when the evidence and possible reasons to do so; (11) they are searching for documents with precision; (12) they agreed in an orderly manner with the parts of the whole complex; (13) they are sensitive to the feelings, knowledge, and intelligence of others; (14) they ask relevant questions; (15) they may admit a lack of understanding or information; (16) they are curious; (17) they are interested in finding new solutions; (18) they can clearly; (19) they define a set of criteria for analyzing ideas; (20) t hey are willing to examine beliefs, assumptions, and opinions and consider them against the facts; (21) they are listening carefully to others and is; (9) they are able to provide feedback; (22) they see that Critical thinking is a lifelong process of self assessment; (23) they suspend judgments until all the facts have been gathered and considered; (24) they find evidence to support assumptions and beliefs; (25) they can adjust opinions when new facts are discovered; (26) they examined the problem closely; (27) they are able to reject information that is untrue or irrelevant.[1] In addition, there are 12 indicators of critical thinking skills that are divided into five major groups below: (1) Provides a simple explanation: a) focus on the question, b) analyze the arguments, c) asking and answering of an explanation or challenge; (2) build basic skills: d) to consider the credibility of the source, e) observed and considered a report of observations; (3)concluded: f) deduce and consider the results of deduction, g) induces and consider the results of induction, h) to make and determine the value of the consideration; (4) further explanation: i) define the term and consider the definition, j) identifying assumptions; (5) setting the strategy and tactics: k) determines the action, l) to interact with others. ASPECTS OF CRITICAL THINKING Critical thinking is a manner that can influence people. That influence is called Aspects of Critical thinking and that aspects are divided by the critical thinking process which has five phases. A full cycle of critical thinking, as described below, usually leads to another triggering event and another journey through the critical thinking process. New assumptions may be challenged, new information gathered and new approaches developed. As they pass through these phases, critical thinkers will engage the four components of critical thinking. At every point they identify and challenge old assumptions, analyze context, look for bias and seek alternatives. These phases lay as follow: Phase 1: Trigger Event. Most people are motivated to start thinking critically by some kind of external event or ideal. This is usually unexpected and causes some kind of inner discomfort or confusion. Trigger events can be both positive and negative. Phase 2: Appraisal. After the triggering event, an uncomfortable period of doubt may follow. This phase can involve an attempt to make light of a concern. Others may keep worrying through this stage, and decide they need to find another approach to dealing with the issue. Phase 3: Exploration. In this phase, people accept that they are moving toward some kind of change or transformation. They ask questions, develop options and make discoveries. They find out about other people who are dealing with similar things. They gather more information. Phase 4: Finding Alternatives. This phase can also be called the transition stage when old ideas are either left behind, or clarified, and new ways of thinking or acting are started. Decisions are made about how far change should go, and how fast. Phase 5: Integration. This phase involves finding ways to fit new ideas and information into everyday lives. In some cases this means making major changes. In other cases, it means confirming the old ideas. STAGES OF CRITICAL THINKER Critical thinking skill also has stages. These stages is a phase that Critical thinker will master the skills. There are 6 stages of Critical thinking laid out are as follows: Stage One: The Unreflective Thinker. Unreflective thinkers most are unaware of the role of determining that the thinking is to play in their lives and the many ways in thinking that the problems that caused the problem in their lives. Unreflective thinkers lack the ability to explicitly assess their thinking and improve it. Stage Two: The Challenged Thinker. Thinkers move to the â€Å"challenged† stage when they become initially aware of the determining role that thinking is playing in their lives, and of the fact that problems in their thinking are causing them serious and significant problems. Stage Three: The Beginning Thinker. Those who move to the beginning thinker stage are actively taking up the challenge to begin to take explicit command of their thinking across multiple domains of their lives. Thinkers at this stage recognize that they have basic problems in their thinking and make initial attempts to better understand how they can take charge of and improve it. Based on this initial understanding, beginning thinkers begin to modify some of their thinking, but have limited insight into deeper levels of the trouble inherent in their thinking. Most importantly, they lack a systematic plan for improving their thinking, they hence their efforts are hit and miss. Stage Four: The Practicing Thinker. Thinkers at this stage have a sense of the habits they need to develop to take charge of their thinking. They are not only recognizing that problems exist in their thinking, but they are also recognizing the need to attack these problems globally and systematically. Based on their sense of the need to practice regularly, they are actively analyzing their thinking in a number of domains. However, since practicing thinkers are only beginning to approach the improvement of their thinking in a systematic way, they still have limited insight into deeper levels of thought, and thus into deeper levels of the problems embedded in thinking. Principal Challenge is to begin to develop awareness of the need for systematic practice in thinking. Stage Five: The Advanced Thinker. Thinkers at this stage have now established good habits of thought which are â€Å"paying off.† Based on these habits, advanced thinkers not only actively analyze their thinking in all the significant domains of their lives, but also have significant insight into problems at deeper levels of thought. While advanced thinkers are able to think well across the important dimensions of their lives, they are not yet able to think at a consistently high level across all of these dimensions. Advanced thinkers have good general command over their egocentric nature. They continually strive to be fair-minded. Of course, they sometimes lapse into egocentrism and reason in a one-sided way. Stage Six: The Master Thinker. Master thinkers not only have systematically taken charge of their thinking, but are also continually monitoring, revising, and re-thinking strategies for continual improvement of their thinking. They have deeply internalized the basic skills of thought, so that critical thinking is, for them, both conscious and highly intuitive. As Piaget would put it, they regularly raise their thinking to the level of conscious realization. Through extensive experience and practice in engaging in self-assessment, master thinkers are not only actively analyzing their thinking in all the significant domains of their lives, but are also continually developing new insights into problems at deeper levels of thought. Master thinkers are deeply committed to fair-minded thinking, and have a high level of, but not perfect, control over their egocentric nature. TYPES OF CRITICAL THINKING SKILLS As explained before, critical thinking is a process of thinking about an idea or ideas in a methodical way and from a variety of angles. One method of thinking critically involves a series of questions to be applied to the idea under consideration. These questions can be broken down into three categories: (1) Questions which help us observe a text; (2) Questions which help us evaluate the text; (3) Questions which help us respond to and use (or apply) the text critically. First skill: Observation skills. Observation skills are the skill of someone to observe the case with given question. The question of observation can be divided into a two subcategories: (1) Those relating to the immediately sated assertion, reasoning, evidence, and conclusion; (2) Those relation to the derived meaning for the reader. Observational questioning includes the personal response of the reader since the reader constructs and in therefore part of the text. Here are some observation-based questions, those which help us identify the assertions, line of reasoning, and systematic explanations: 1. What are the meanings of the special terms in this text? 2. What is the point of the text, namely the authors conclusion (thesis)? 3. What evidence does the author give? 4. What is the actual path of reasoning offered? Second skill: Evaluation Skills. Evaluation Skills is evaluating the stated text in relation to the history of its ideas and imbedded beliefs and looking at contextual elements such as the method of gathering, evidence, the mode of presentation, the assumption behind the logic of the reasoning, and the events which led to the methods, presentational form, and assumptions. In other words, in evaluation questions, we historicize the stated text. Here are some examples of evaluation skill questions: 1. Are the meanings of the special terms ambiguous in any way? How so? 2. Does the evidence make sense? Why or why not? 3. Does evidence match the conclusions? If not, what might explain the mismatch? 4. Does the reasoning lead well from assertion through evidence to conclusion or are there gaps in the sequencing or ambiguity in the language? 5. What other conclusions might be drawn? 6. What other evidence might be brought to bear on the reasoning? 7. What other assertions might have been made? 8. Why might the author have left out evidence which changes the meaning of the text? Third skill: Critical Response and Application skills. To further reveal the mosaic of idea, evidence, and intention, the critical thinker will usually include him/her in some way part of the context, using a third set of questions. The following response/application questions lead to a critical understanding of the readers relationship to a text: 1. What is it about this text that interests me? 2. Did I agree or disagree strongly with the author any time during the course of reading the text? What is the precise language I disagree with? 3. Does the idea under consideration relate in any way to my own life or lives of people I know? How so? 4. Why I am interested in this text? 5. Is there something I might gain or lose by accepting the conclusion of the author? What is the gain or loss? 6. Do the values and beliefs of the author appear to match my own? If not, is this mismatch responsible for my judgment of the idea? The response/application questions, like evaluation questions, are â€Å"why† questions. They dig into the casual factors shaping ideas, evidence, methods, and presentational forms of thought. As such, they are the foundation of thoughtful critique and argumentation. HOW TO BE A GOOD CRITICAL THINKER Furthermore, the next topic is the way to be a good critical thinker. Here are the steps that can be followed by someone who wants to be critical thinkers. The questions related to each other following allows people to evaluate their own thoughts and ideas of others. If people use these questions with organized to assess their thoughts on various topics or evaluate ideas they find in articles, books, conversations and other places, they will come to the conclusion that an independent and credible. By using these questions on a regular basis, people learn to examine assumptions, facing prejudice, recognize different points of view, considering the meaning of the word, noting the implications of the conclusions and evaluate evidence.Each person can learn to think critically because the human brain is constantly trying to understand the experience. In continuing quest for meaning, the brain connects abstract ideas with real-world context.The following steps are presented in the form of a question. Because by answering questions, people involved in mental activities that they need to obtain a deep understanding. These questions are presented in the order thoroughly examine each problem, issue, project, or the decisions faced by the people especially the students in the face of learning in the classroom or personal experience.The steps of critical thinking are as follows: Ask questions; be willing to wonder. Always be on the lookout for questions that have not been answered in the textbooks, by the experts in the field or by the media. Be willing to ask whats wrong here? and/or Why is this way it is, and how did it come to be that way? Define the problem. An inadequate formulation of question can produce misleading or incomplete answers. Ask neutral questions that dont presuppose answers. Examine the evidence. Ask yourself, What evidence supports or refutes this argument and its opposition? Just because many people believe, including so-called experts, it doesnt make it so. Analyze assumptions and biases. All of us are subject to biases, beliefs that prevent us from being impartial. Evaluate the assumptions and biases that lie behind arguments, including your own. Avoid emotional reasoning: If I feel this way, it must be true. Passionate commitment to a view can motivate a person to think boldly without fear of what others will say, but when gut feelings replace clear thinking, the results can be disastrous. Dont oversimplify. Look beyond the obvious, rest easy generalizations, reject either/or thinking. Dont argue by anecdote. Consider other interpretations. Formulate hypotheses that offer reasonable explanations of characteristics, behavior, and events. Tolerate uncertainty. Sometimes the evidence merely allows us to draw tentative conclusions. Dont be afraid to say I dont know. Dont demand the answer. REQUIREMENTS TO BE A CRITICAL THINKER If there is a way, there is also a requirement. This matter also occurred in Critical thinking. These are 16 requirements to be Critical Thinker that must be fulfilled to reach the goal: (1) state and explain goals and purposes; (2) clarify the questions they need to answer and the problems they need to solve; (3) gather and organize information and data; (4) explicitly assess the meaning and significance of information you give them; (5) demonstrate that they understand concepts; (6) identify assumptions;( 7) consider implications and consequences; (8) examine things from more than one point of view; (9) state what they say clearly; (10) test and check for accuracy; (11) stick to questions, issues, or problems; and not wander in their thinking; (12) express themselves precisely and exactly; (13) deal with complexities in problems and issues; (14) consider the point of view of others (15) express their thinking logically; (16) Distinguish significant matters from insignificant ones.[2] APPLYING CRITICAL THINKING In peoples life there are many types of Critical thinking can be applied, but in this explanation will be focused just on two Applications. They are Application Critical thinking in Reading and American History. Apply to Reading (Critical Reading). One alternative to increase students critical thinking skills is to become familiar with critical reading. Habituation is not only done by teachers or Lecturers language (more specifically the faculty to read) but also by all teachers of all disciplines. Is not the modern learning process, in the field / discipline of any kind, theres always reading.There are equal parts between the activities of critical thinking with reading activities. Both require the brain works. The core activities of critical thinking are the use of reason in judging the truth of something. Similarly, reading activities, in which there is a process of reasoning to understand the meaning of written symbols. Thus, the process of learning and habituation to read is essentially a process of learning and habituation to think too. One type of reading activity in which obviously requires the ability to think critically is a critical reading. Critical Reading is the ability and willingness to assess claims and make objective assessments based on well-supported reason in the reading. These seven critical reading strategies can be learned readily and then applied not only to reading selections in a Literature class, but also to your other college reading. Mastering these strategies will help to handle difficult material with confidence. Annotating. Annotating is an important skill to employ if you want to read critically. Successful critical readers read with a pencil in their hand, making notes in the text as they read. Instead of reading passively, they create an active relationship with what they are reading by talking back to the text in its margins. And annotation is a key component of close reading. Since we will annotate texts all year, you need to develop a system Effective annotating is both economical and consistent. The techniques are almost limitless. Use any combination of the following: (1) Make a brief comments in the margins. Use any white space available inside cover, random blank pages; (2) make brief comments between or within lines of the text. Do not be afraid to mark within the text itself; (3) circle or put boxes, triangles, or clouds around words or phrases; (4) use abbreviations or symbols brackets, stars, exclamation points, question marks, numbers, etc; (5)Connect words, phrases, ideas, circles, boxes, etc. with lines or arrows; (6) underline (CAUTION: Use this method sparingly). Underline only a few words. Always combine with another method such as comment. Never underline an entire passage. Doing so takes too much time and loses effectiveness. If you wish to mark an entire paragraph or passage, draw a line down the margin or use brackets; (7) highlight See underline. You cannot write with a highlighter anyway; (8) create your own code. (9) Use post-it notes only if you have exhausted all available space (unlikely). Previewing. Previewing is learning about a text before really reading it. Previewing enables readers to get a sense of what the text is about and how it is organized before reading it closely. This simple strategy includes seeing what you can learn from the headnotes or other introductory material, skimming to get an overview of the content and organization, and identifying the rhetorical situation. Previewing is especially useful for getting a general idea of heavy reading like long magazine or newspaper articles, business reports, and non-fiction books.It can give you as much as half the comprehension in as little as on tenth the time. For example, you should be able to preview eight or ten 100-page reports in an hour. After previewing, youll be able to decide which reports (or which parts of which reports) are worth a closer look.Heres how to preview: Read the entire first two paragraphs of whatever youve chosen. Next read only the first sentence of each successive paragraph. Then read the entire last two paragraphs.Previewing doesnt give you all the details. But it does keep you from spending time on things you dont really want-or need-to read.Notice that the previewing gives you a quick, overall view of long, unfamiliar material. For short, light reading, theres a better technique. Contextualizing. The contextualizing is the way to placing a text in its historical, biographical, and cultural contexts. When you read a text, you read it through the lens of your own experience. Your understanding of the words on the page and their significance is informed by what you have come to know and value from living in a particular time and place. But the texts you read were all written in the past, sometimes in a radically different time and place. To read critically, you need to contextualize, to recognize the differences between your contemporary values and attitudes and those represented in the text. Questioning. Questioning is about understanding and remembering by asking questions about the content. Questions are designed to help you understand a reading and respond to it more fully, and often this technique works. When you need to understand and use new information though it is most beneficial if you write the questions, as you read the text for the first time. With this strategy, you can write questions any time, but in difficult academic readings, you will understand the material better and remember it longer if you write a question for every paragraph or brief section. Each question should focus on a main idea, not on illustrations or details, and each should be expressed in your own words, not just copied from parts of the paragraph. Reflecting. It means that reflecting on challenges to your beliefs and values by examining your personal responses. The reading that you do for this class might challenge your attitudes, your unconsciously held beliefs, or your positions on current issues. The steps are bellow: (1) As you read a text for the first time, mark an X in the margin at each point where you fell a personal challenge to your attitudes, beliefs, or status. (2) Make a brief note in the margin about what you feel or about what in the text created the challenge. (3) Now look again at the places you marked in the text where you felt personally challenged. (4) Then check the patterns that you see. Outlining and summarizing. Outlining and summarizing is identifying the main ideas and restating them in your own words. Outlining and summarizing are especially helpful strategies for understanding the content and structure of a reading selection. Whereas outlining reveals the basic structure of the text, summarizing synopsizes a selections main argument in brief. Outlining may be part of the annotating process, or it may be done separately (as it is in this class). The key to both outlining and summarizing is being able to distinguish between the main ideas and the supporting ideas and examples. The main ideas form the backbone, the strand that holds the various parts and pieces of the text together. Outlining the main ideas helps you to discover this structure. When you make an outline, dont use the texts exact words. Summarizing. Summarizing begins with outlining, but instead of merely listing the main ideas, a summary recomposes them to form a new text. Whereas outlining depends on a close analysis of each paragraph, summarizing also requires creative synthesis. Putting ideas together again in your own words and in a condensed form shows how reading critically can lead to deeper understanding of any text. Evaluating an argument. Evaluating an argument means testing the logic of a text as well as its credibility and emotional impact. All writers make assertions that want you to accept as true. As a critical reader, you should not accept anything on face value but to recognize every assertion as an argument that must be carefully evaluated. An argument has two essential parts: a claim and support. The claim asserts a conclusion an idea, an opinion, a judgment, or a point of view that the writer wants you to accept. The support includes reasons (shared beliefs, assumptions, and values) and evidence (facts, examples, statistics, and authorities) that give readers the basis for accepting the conclusion. When you assess an argument, you are concerned with the process of reasoning as well as its truthfulness (these are not the same thing). At the most basic level, in order for an argument to be acceptable, the support must be appropriate to the claim and the statements must be consistent w ith one another. Comparing and contrasting related readings. Comparing and contrasting related readings means Exploring likenesses and differences between texts to understand them better. Many of the authors on the subject of thinking critically approach the topic in different ways. Fitting a text into an ongoing dialectic helps increase understanding of why an author approached a particular issue or question in the way he or she did. Apply to American History. Being able to distinguish between a statement of fact, an opinion or an inference is an important skill to critical thinking. It involves knowing what can be proven directly, what is a legitimate implication derived from the facts, and what is fair to conclude from the historical record. Historians typically interweave statements of fact, inferences they derive from the facts, and statements of their own opinion into a seamless historical narrative. Critical thinkers must be able to distinguish among these three types of communication. (1) FACT: reports information that can be directly observed or can be verified or checked for accuracy. (2) OPINION: expresses an evaluation based on a personal judgment or belief which may or may not be verifiable. (3) INFERENCE: a logical conclusion or a legitimate implication based on factual information. Generally, facts are constants in historical study. But a compendium of facts is inevitably incomplete and deathly dull to read. Historians construct history by closing the gaps in their knowledge about the past, enlarge our under- standing, and enliven their narrative by drawing logical inferences from their assembled facts. Often, they then use their expertise to arrive at a considered judgment about the wisdom or significance of past decisions and events. ADVANTAGES BECOME CRITICAL THINKER Each good manner must have its advantages. If people have succeeded mastering Critical Thinker, he/she will get big advantages. Reality TV and Morality

Invention of television is a product of a spectacular brain who has a great influence on everybody’s life nowadays, some of them are mortal, some of them are like brain-washing and some are just a little just because of reality televisions. This reality television changes the concept of reality in people’s mind. Television first started as our eye for outer world which we don’t know about and for being informed which we can say a â€Å"tool† but now it is just our â€Å"aim† to be on television. So this is forming obsessed brains which causing death of morality as Rushdie says. First of all, main reason why people are joining these reality programmes is just the anxiety of being rich and famous which are the most two important notions in western society in these days (Rushdie, 2010, p. 63). Contestants are doing bizarre and disturbing just for obtaining wealth and fame, like a guy fried his hand at American Survivor (Rushdie, 2010, p. 63). This leads us Rushdie’s thesis â€Å"good to be bad† (Rushdie, 2010, p. 64) from which it is comprehensible that people acts like mindless zombies like the hand frying guy. Good to be bad† refers to a lot of other things too like being selfish just for winning prize and being double faced in the competition. So it forms a question in mind; do you really need to be talented to win these competitions? Absolutely no (Rushdie, 2010, p. 63). You just need to play the game with its â€Å"corrupted† rules. One of the biggest immoral issues is the first death on television (Rushdie, 2010, p. 64) which n egates the most basic natural right that we have. Moreover, it is need to define what morality is. It distinguishes good and bad. However, â€Å"good to be bad† ignores it completely. As it became a common ritual to watch television in home with the whole family, children will be affected heavily by these programmes and generation by generation the spirit of morality will change or collapse. However producers don’t care others much, they just need ratings, big articles in newspapers next day after the show just for their name to be written on those piece of papers. These producers are enough blind and shallow that they can’t see influence of these programmes on society, so we are being acted like a guinea pig. They are just damaging society’s mental stability and pushing them act immoral in their lives without consciousness with injecting these awkward behaviours by their programmes. So basically contestants and producers are becoming famous without doing anything else. This is just an unfair way of tricking people and paralyzing them in front of television and even it annihilates our understanding of morality. Furthermore, there is another point of view which is not able to not to take into consideration about those poor contestants. Poniewozik tells that: â€Å"Isn’t there something simply wrong with people who enjoy entertainment that depends on ordinary people getting their heart broken, being told they can’t sing, or getting played for fools? â€Å" (Poniewozik, 2010, p. 70). It is really sad that some people are enjoying with this stuff. As spectators are the people who watch television in their home, it is acceptable to say that, there are lots of â€Å"already diseased† brains which are exempt of notion of morality. Everyone can imagine children will be affected more than everyone. They will be lost while they are searching their personalities and it is a high odd that they canalise to wrong role models for their life. So they are the main and the weakest victims. Something must be done to avoid for our future generation not to get attracted by those programmes or they should be aware while watching those television programmes or it is fatal that humanity will lose the â€Å"judgement ability†. As a result, these ideas show us that reality tv’s are really dangerous and causes death of morality. These un-realistic programmes are being watched nowadays and spectators don’t have any idea what they are watching. It’s clear that reality tv’s are absurd and not worth to watch. However there are no ways to avoid watching them because we can not limit or cut television sells. Immoral behaviours will increase day by day; if this problems goes on, there will be serious behaviour malfunctions in society. Some can say not to watch them but it will just enter from left ear and fly out from right ear. It’s able to see that Rushdie is right with his arguments so it’s clear that reality tv is a regret.

Not only are her communication deficiencies evident in her own messages, they are apparent in her interpretation of Romeos speech. She very nearly delivers the wrong message to Juliet! Obviously, Nurse never confronts this obstacle. Romeo often has to question her interpretation of his messages to Juliet, but she seems unaware of her linguistic flaws. In both stories you have women that are not happy in their situations, seeming to always be wanting for more. While the stories are very different, they do have a similar message. Dr.  Emily Chen, PhD states:† that reading a literary text is part of a complex process that includes collaboration between the writer, the text, and the reader. Text is re-created every time someone new reads it, and it becomes, in the process, increasingly richer. Text is a stimulus that elicits responses from us based on our past experiences, our previous reading, our thoughts, and our feelings: the text acts on the reader and the reader interacts with the text†. (Chen, 2009). Each story, read by each person will most likely illicit a different view based on their life experience, mood, age and gender. â€Å"Your environment and personal experiences influence your response to stories. Whether you are aware of it or not, the lens through which you envision a story is filtered by insights you have gained from family traditions, religious beliefs, and critical life issues. Thus, interpretations of a story vary based on the readers age and breadth of experience. Emotions affect conclusions drawn from stories. Interpretations differ from culture to culture. †(Clugston, 2010). Reading each of these stories now, affect me differently than if I had read them ten, fifteen or twenty years ago. The Necklace and Story of an Hour are both short stories set in about the same time period, the late 1800’s, in private residences. The Necklace is a story about a woman, Madame Loisel that is unhappy with her simple life as a clerk’s wife. She is always daydreaming about the finer things in life and the riches that she feels that she is missing out on. â€Å"She suffered intensely, feeling herself born for every delicacy and every luxury. She suffered from the poverty of her dwelling, from the worn walls, the abraded chairs, the ugliness of the stuffs. † (de Maupassant, 1884). Madame Loisel’s husband, in an effort to try and bring her happiness, receives an invitation to a party with the elite townspeople. Still not happy because she did not have an appropriate dress to wear, Madame Loisel’s husband gives her the money he was saving for himself so she could go out and purchase a dress. Even then she is still not happy because she has no jewelry to wear with it. She asks her friend Madame Forrester to borrow her something appropriate and ends up borrowing a â€Å"diamond† necklace from her. Ultimately, the necklace is lost the night of the grand party. Madame Loisel and her husband end up working themselves to death for the next ten years to pay off the debt they incurred in replacing the necklace, which ended up being a fake in the end. Their life as they once knew it was over. Story of an Hour is a short story featuring Louise Mallard, an unhappy housewife with a heart condition. In the story she learns of her husband’s death and within minutes goes from weeping uncontrollably to happy and joyful. â€Å"She said it over and over under her breath: free, free, free! The vacant stare and the look of terror that had followed it went from her eyes. † (Chopin, 1884). Mrs. Mallard felt oppressed in her marriage, that her husband did not love her and found a sense of freedom from his passing. â€Å"She knew that she would weep again when she saw the kind, tender hands folded in death; the face that had never looked save with love upon her, fixed and gray and dead. But she saw beyond that bitter moment a long procession of years to come that would belong to her absolutely. † (Chopin, 1884). Ultimately, Mr. Mallard did not pass in the accident and when he came through the door and she saw him, Louise passed right then. Each story features an unhappy woman as the main character. Madame Loisel in The Necklace is unhappy with her financial situation, always fantasizing about the finer things in life. Louise Mallard in Story of an Hour is an unhappy housewife with a heart condition, feeling oppressed in her marriage. In the end, both women pay a price for their wants: Madame Loisel to be wealthy or seen as wealthy pays by having to sacrifice her life to work twice as hard to repay a debt. Louise Mallard wanting her freedom finally receives it when she hears her husband has been killed in an accident, only to lose it with her death as he actually walks in the door. Foreshadowing is used in both these stories as well. Foreshadowing is described in our textbook as:†A technique a writer uses to hint or suggest what the outcome of an important conflict or situation in a narrative will be† (Clugston, 2010). Foreshadowing gives us some clues as to some of the events that will may possibly unfold in the stories. In The Necklace, the line It was not I, madam, who sold this necklace. I only supplied the case. (de Maupassant, 1884) provides a small hint that the necklace may not in fact have been genuine diamonds. In Story of an Hour, the simple fact that the opening line stated Louise Mallard had a heart condition I feel, provided a clue right away as to the fact she would die in the story. The line â€Å"someone was opening the front door with a latchkey. † (Chopin, 1894), also gives a clue that she could be surprised enough to have her heart fail. â€Å"There was something coming to her and she was waiting for it, fearfully. What was it? She did not know; it was too subtle and elusive to name. But she felt it, creeping out of the sky, reaching toward her through the sounds, the scents, and the color that filled the air. † (Chopin, 1894). This line, I feel, shows that Loise may even have felt her impending death. Possibly the reference in the line â€Å"But she felt it, creeping out of the sky, reaching toward her through the sounds, the scents, the color that filled the air. † (Chopin, 1894), could be a reference as to Jesus coming to take her to heaven. Irony takes place in both of these stories as well. Irony is defined in out textbook as: â€Å"A discrepancy or contradiction occurs between what is expected to happen and what actually happens in a situation (situation irony) or in an expressed statement (verbal irony). † (Clugston, 2010). Irony is shown in The Necklace when Madame Loisel runs into Madame Forrester on the street. Her friend did not recognize her because she had aged so much from all the extra work she had to do to pay her debt. They have a conversation about the necklace and how she had lost it and replaced it, I brought you back another just like it. And now for ten years we have been paying for it. You will understand that it was not easy for us, who had nothing. At last, it is done, and I am mighty glad. (de Maupassant, 1884) and Madame Forrester replies Oh, my poor Mathilde. But mine were false. At most they were worth five hundred francs! (de Maupassant, 1884). Madame Loisel had the exact opposite of the life she had fantasized about. Irony is shown in Story of an Hour by the fact that Louise was so elated at the thought of her new found freedom that he started visualizing her future alone and thought â€Å"It was only yesterday she had though with a shudder that life might be long. † Little did she know her life would end up shorter than she could imagine. Both of these stories represent death in the way that Madame Loisel and her husband’s life as they knew it died the night the necklace was lost. Louise Mallard simply died, I feel, from seeing her freedom being taken away by her husband still being alive: her heart simply could not take it. She not only lost the freedom she so longed for when her husband walked through the door, death made it impossible for her to ever have that freedom. These stories hold differences as well. The Necklace is set in Paris and spans years while the Story of an Hour does not give an exact place but is most likely set near where the author lived in St. Louis, Missouri and only denotes one hour of time. In The Necklace, Madame Loisel’s husband is always trying to make her happy, first by bringing her an invitation: But, my dear, I thought you would be pleased. You never go out, and heres a chance, a fine one. I had the hardest work to get it. Everybody is after them; they are greatly sought for and not many are given to the clerks. You will see there all the official world. (de Maupassant, 1884) and giving her money to buy a dress. Even though Madame Loisel is unhappy with her financial situation, it is never implied that she is unhappy with her husband. In Story of an Hour however, it is implied that Louise Mallard is unhappy in her marriage and she did not feel loved by her husband, â€Å"the face that had never looked save with love upon her†. (Chopin, 1894) nor did she love him, â€Å"And yet she had loved him—sometimes. Often she had not. What did it matter! † (Chopin, 1894). I feel that the only time Louise Mallard is truly happy is when she thinks she finally has the freedom to do whatever she wants. Each of these stories has women represented in different ways, most likely because they were written by different gendered authors. Story of an Hour was written from a female point of view and The Necklace was written from a male point of view. The time frame in which these stories were written is a significant factor in the style they were written. The late 1800’s was the beginning of the Women’s Movement. Many women longed for freedom, and men still viewed them as property. Kate Chopin was called a Liberationist during this time. Lewis Leary speaks of her writings in that â€Å"she wrote also of people (mostly women) caged by convention or lured toward freedom which brings at one time happiness, at another disaster or rebuff. † (Leary, 1970). He also discusses her personal views during this era. †Ms. Chopin was in revolt against tradition and authority. She saw sex as something which could or could not be conjoined with love or marriage, and she daringly – how daringly for her time and place! – undertook to give the unsparing truth about woman’s submerged life. † (Leary, 1970). In Story of an Hour, Louise Mallard is a woman who feels oppressed in her marriage and longs for freedom. In The Necklace, written from male point of view, portrays Madame Loisel as a greedy, materialistic woman worried about status and not happy with what she has. â€Å"Since early times, women have been uniquely viewed as a creative source of human life. Historically, however, they have been considered not only intellectually inferior to men but also a major source of temptation and evil. In Greek mythology, for example, it was a woman, Pandora, who opened the forbidden box and brought plagues and unhappiness to mankind. Early Roman law described women as children, forever inferior to men. † (WIC, 1994). Most men during this period felt women were inferior and their place was as a homemaker. They were considered the weaker sex and had few rights and Maupassant was no exception. According to Karen Bernado â€Å"He enjoyed visiting brothels, and his easy familiarity with prostitutes is reflected in stories such as Boule de Suif Ball of Fat, a quasi-endearing nickname for a voluptuous whore. He recognized how people can be brought down by vanity, a situation depicted in his famous story The Necklace. And he was fascinated with humanitys darker side, as we learn from his masterful character study of an effeminate military officer in Mademoiselle Fifi. His lifestyle, however, was to prove de Maupassants undoing; he died insane and far too young from complications brought on by syphilis. †(Bernardo, nd). He viewed women as nothing more than objects. Maupassant was â€Å"a classicist by his nearly exclusive study of the subject of man, concentrating on the rational man. † (Moore, 1918). Some of the qualities credited to him are realism and impersonality. â€Å"Maupassant is a realist so long as, from the point of view of a detached observer. † (Moore, 1918). I feel that a womans’ role in the 1890’s affected the way Maupassant wrote this story. The relationship between content, form and style in these two stories are similar in many ways. Our textbook says: †Stories also reflect culture. The term culture refers to common characteristics of a group or a region. Culture is never static; it is a changing phenomenon, constantly reconfigured by human behavior, language, laws, events, patterns, products, beliefs, and ideals. To put it simply, culture refers to a way of life, an ethos. Writers often reflect a particular culture through the setting of a story or the spirit of the characters lives—providing insight, for example, into Southern culture, post–World War I culture, or global culture. In this way stories preserve culture: they freeze moments in time and create cultural awareness. †(Clugston, 2010). I believe both of these stories reflect the culture of the late 1800’s, from very different viewpoints, male and female, but provide a similar morality lesson. Both are short stories and contain a set up, build up and payoff. Short stories have a plot with conflict–driven, tied–together actions and events, a setting, clear time frame, characters, point of view, a theme and features that include tone, irony, and symbolism. Knowing or not knowing the terms presented in this paper does not help or hinder a personal connection someone may have with a particular piece. I know for myself, the personal message I received from these stories, was a reflection on my life and personal experiences. I see people ungrateful for what they have daily. I was one of those people once, a long time ago. When we long for things we do not have, it keeps us from seeing and appreciating what we do have. You get caught up in things, and become willing to lie, cheat, steal, to do whatever it takes to get what you want. Imagine if Madame Loisel had just been content with being invited to the party and not worried about a dress and jewelry? Or what if she had just told the truth about losing the necklace? She would probably have not had to work the next ten years and been able to enjoy life. Socrates once said â€Å"He who is not contented with what he has, would not be contented with what he would like to have. † The bible contains many parables about it as well and Proverbs 15:27 states â€Å"A greedy man brings trouble to his family, but he who hates bribes will live. † As you can see, there are many similarities and differences between the short stories The Necklace and Story of an Hour. I feel one important message contained in these to be happy with what you have, because greed will get you in the end, and both characters paid a price for their greed. If Madame Loisel had been happy with her life as it was, her husband would have never felt the need to acquire the invitation to the party, which ended up costing them years of their lives as well as money. For the next ten years Madame Loisel had a life less than what she started with, a big contrast to the life she fantasized about. Louise Mallard was unhappy in her marriage. Thinking she finally had her freedom when she thought her husband had been killed, she was overjoyed; only to have her heart give out when she found out her husband was still alive. Malaysia Maritime Environmental Issues and Its Impact CHAPTER 1 INTRODUCTION 1.1 BACKGROUND Seas and oceans traditionally used by us to have all the source of rich, opportunity and abundance. The vast area of it has given us the aspiration either to use or to abuse it.   Most of the countries in this world are connected with sea and ocean, which make the line of communication and transportation easily done through it.   Many years ago while air transportation is impossible, transportation through land could take a month to reach. Sea and ocean line was used heavily either for trade, communication or expanding the power beyond the borders.   The increasing awareness by us has changed the point of view that the feel of appreciation which not only in a sense of importance for economy and social, but also in a sense of security.   Maritime security and safety issues are major and hot topics nowadays.   It is spoken all over the world, especially in this modern and globalise era where crime has no longer a matter of a single country but a matter concerning everybody.   It is borderless and at any time can happen anywhere.   Because of the large maritime area, this crime is very difficult to contain particularly in the area where the enforcement is less due to lack of security assets.   This situation worries the country, especially those are depending directly to the sea as a source of development. Maritime threats have existed ever since commerce went to sea.   Now, its just in what capacity and in what dimension.   Threat to maritime in aspect of maritime security and safety can be from any kind such as piracy, sea robbery, human trafficking, smuggling and others, which cover up to sea pollution.   Malaysias total sea area of 614,159 square kilometres is almost twice its landmass and the size of itsExclusive Economic Zone(EEZ) alone is 453,186 square kilometres.   An estimated 70 percent of the population lives along 4,800 kilometres of coastline area, which have rich ecosystem and biodiversity.]With these unique backgrounds, it has offered tremendous economic value and prospects to Malaysia.   Major economic activities are offshore petroleum, marine transport, marine tourism, fisheries and aquaculture. As a maritime nation, Malaysia is a party to a number of international conventions dealing with marine pollution, which laid down important rules to be followed by s tate parties to prevent and control marine pollution.   Some reports have concluded that the quality of marine environment and life in our country is showing signs of decline.According to Oxford Dictionary (7th edition) environmental issues can best define with something connected to natural conditions that affect behaviour and development of something.   To be more precise, environmental issues are negative aspects of human activity on the biophysical environment.   Few examples of maritime environmental issues are conservation, environmental degradation, environmental health, nanotechnology, nuclear issues, water pollution, air pollution and resource depletion.   To explain further, the definitions of environmental issues in law perspective as follows: Any direct or indirect alteration of the physical, thermal, chemical, or biological properties of any part of the environment by discharging, emitting, or depositing environmentally hazardous substances, pollutants or wastes so as to affect any beneficial use adversely, to cause a condition which is hazardous or potentially hazardous to public health, safety, or welfare, or to animals, birds, wildlife, fish or aquatic life, or to plants or to cause a contravention of any condition, limitation or restriction. Royal Malaysian Navy (RMN) is one of the maritime agencies in Malaysia which one of the roles and functions is to safeguard our national interest.   Hence, theroles and functions are the bread and butter to the RMN, and of course it is not limiting the usage, freedom of manoeuvres in Malaysian waters for whatever reasons.   In connection to maritime environmental issues, the RMN has a strong sense of commitment in upholding the community values of Malaysia.   At the forefront of these values are respect for the environment and a growing need to ensure that naval operations are undertaken by sustainable methods and that the environment is preserved for future generations. 1.2 PROBLEM STATEMENT With the current capabilities and ageing of warships, RMN has a bigger issues to adhere to the rules and regulations with regards to environmental friendly and thus will affect the conduct of RMN Operations.Indeed there are inventions of new environmental friendly technologies and of course will increase operational efficiency, but due to the limited budget on national defence sector, RMN is to wisely maintain its own asset and at the same time parallel to environmental issue requirements. 1.3 OBJECTIVE S The objectives of this study as follows: To examine the relationship between Naval Operations and maritime environmental issues. To determine what is the negative factor contributes by RMN warships in relations to maritime environmental issues. To determine whether the capability of RMN in conducting operations isconstrainedby the current environmental policy and legislation. To suggest solutions towards the environment compliant warship without jeopardizing required operations. 1.4 SIGNIFICANCE OF THE STUDY RMN warships are not much different with any commercial vessel and thus should comply withenvironmental regulations such as the Environment Quality Act 1974.   Due to the integrity, RMN should set a very good example in complying not only to the act, but to adhere to the United Nations Convention on the Law of the Sea (UNCLOS) 1982 and a number of international maritime environmental conventions in order to portray a good image to the public.   RMN warships should be able to operate without restriction in ports or open seas.   Due to some intensive measures on environmental issues, there aresome restrictions and constraint on naval activity with regards to ships design and conduct of operations.   Hence, the study should be able to determine the best solution for win-win situation. 1.5 LITERATURE REVIEW The literature of the research mainly based on environmental thesis papers,which havebeen done by scholars as a reference.   Generally, the literature addresses Malaysias environmental qualities, environmental justice and common public attitudes towards the environment.   It is further discussed about policies, practices and Malaysias commitment to international agreements which to be scrutinized.   The literature as well as provides information with regards to consequences of the fast track style of development on our natural resources, health, quality of life and ecosystems. 1.6 LIMITATIONS OF THE STUDY The preparation of this research paper is based on the secondary data,mainly from books and other published articles.   Most of the material from military references are classified Restricted.   Therefore, limits the research on the subject matter. Time constrained is the biggest setback and hindered a more commendable study of the existing issues. 1.7 METHOD AND SOURCES The primary method will be through literature research.   Therefore, the sources will be published books and journal articles spanning the subject areas of Malaysia Environment Issues and RMN Operations.   Newspaper articles, speeches by relevant personalities and interviews will also be sought after.   Information will also be extracted from official governmental or organisation websites. 1.8 CHAPTER OUTLINE The paper will be organised into five chapters as follows: Chapter 1 : Introduction . This chapter is the introduction of the subject and layout of the paper. Chapter 2 : Maritime Operations .   This chapter will elaborate the concept and conduct of Naval Operations focusing on the RMN. Chapter 3 : Existing Maritime Environmental Issues and Degree of RMN Compliance .   This chapter examines a series of environmental issues, related to shipping design and operation.Its further discuss the degree of compliance for each issue, against existing environmental legislation and regulations. Chapter 4 : Impacts to RMN .   This chapter will discuss the impact on RMN current operations and to determine whether the capability of RMN in conducting operations is constrained by the current environmental policy and legislation. Chapter 5 : Conclusion .   This chapter includes a discussion on the possible outcomes and to suggest solutions towards an environment compliant warship without jeopardizing required operations. CHAPTER 2 MARITIME OPERATIONS 2.1 INTRODUCTION During the course of recorded history, mankind has perpetually looked towards the sea as a provider of nourishment, as a channel for trade and for the migration of people, culture or idea. The last three millennia has witnessed the development of maritime craft from simple design to the fully computerised ships of the modern day era.   In relation to safe guard maritime national security, warship has been designed and developed as a symbol of supremacy and struggle for control of the seas and trade influence in faraway lands.   Warships have been instruments of both good and evil and have influenced the evolution of mankind.   As a maritime nation, Malaysia is not excluded in enhancing and developing its naval capabilities.   Located at the crossroads of Southeast Asia and the sea are seen as an increasingly important factor in the economic and security aspect of this country. The Royal Malaysian Navy (RMN) started from humble beginnings with a rudimentary naval force of coal burning launches and small coastal patrol boats during the colonial time.   Today, the RMN fleet comprises an assortment of modern warships, submarines and naval helicopters armed with state of the art command, control, communication, computers and information (C4I) armed with long-range guided missiles and protected by the most modern electronic warfare systems.   This has completed the metamorphosis of RMN from the coastal Brown Water Navy into a Blue Water Navy, a modern armada. In order to parallel with its vision ‘To be a World Class Navy (Always Excellent), RMN have to be a committed organisation, competent, forward looking, strive for quality and always seek for continuous improvement in managing its own source and technology.   Presently, the roles of the RMN are two-fold; during wartime, the RMN is to ensure the maritime sovereignty of Malaysia while during peacetime, its role is to protect the nations maritime interest that included Malaysias offshore resources, especially oil and gas, shipping and fishing. Since environmental issues are a major challenge and concern throughout the world, the RMN has to develop its operations toward supporting the environmental friendly. 2.2 NAVAL OPERATIONS Naval operations will be the largest contributor toward the maritime environmental issues if it is not being tackled well.   To narrow down the scope of this research, the focus and discussions will be towards the RMN operations.   Every naval exercise always associated with the universal role known as ‘The Trinity of Naval Functions (Figure 2.1) namely military, constabulary and diplomacy.   The first role is the military which is to enforce of state sovereignty and defend the national jurisdictions in the sea by way of control and deterrence at sea.   Secondly is constabulary roles, the navy carried this to enforce the security and law to protect marine resources and the national marine wealth, to maintain order at sea and to support the national development.   The third role is diplomacy. Naval forces are the visible mobile and potent symbols of the nation state and such are the useful instruments of foreign policy.   These roles and functions are the bread and b utter to the RMN, and of course it is not limiting the usage, freedom of manoeuvres in Malaysian waters for whatever reasons. 2.3 MARITIME WARFARE AREAS Malaysia as a maritime nation is the facts that cant be argued about.   The sea area is larger than the land mass and a unique feature of being a country split by an ocean supporting the facts.   Malaysia is divided by the South China Sea into two main land masses namely the Peninsular Malaysia on the western side and Sabah and Sarawak on the eastern side.   These two land masses are being separated by more than 1000 kilometres of navigable waters.   Malaysia and the nations of the region are reliant on the sea for transportation; they draw greatly on the maritime environment for living and mineral resources.   Maritime forces have significant access and control in our region.Thus, Malaysia requires maritime forces able of curb the challenges of our strategic geographical conditions. The RMN is essentially responsible for protecting Malaysias maritime interest.   To meet these tasks, the RMN is provided with various assets ranging from old and obsolete patrol craft to the most modern and highly sophisticated state of the art frigates and corvettes capable of carrying out all the four dimensions of naval warfare, namely surface, sub-surface, air and electronic warfare. 2.3.1 Anti Surface Warfare ( ASu W ) The main dimension of Naval Operations is ASuW defined as follows: The actions necessary to detect, identify and counter an adversarys surface capability.   ASuW operations, which may include sea control and sea denial operations, disruption of Sea Lane of Communications (SLOCs), defence offriendly forces from surface attack, or a combination of all, seek toensure that the necessaryaction are conducted in a timely fashion, denying any adversary the ability to employ forces in an effective manner. Thus, freedom of manoeuvre and able to sustain long period of operations is the major requirements for the RMN warships. 2.3.2 Anti Submarine Warfare (ASW) In order to counter subsurface threat, RMN warships must be able to detect the enemy using any available sensors.   Therefore to locate a submarine requires a very hectic and thorough procedure which this will requires warships to stay longer at operational area.   The elements of ASW as follows: ASW comprises operations with the intention of denying the opponent the effective use of submarines.   The ASW protection of a force depends on defence in depth and close coordination between ships, helicopters, Maritime Patrol Aircraft (MPA), shore-based facilities and friendly submarines.   The complexity of such coordination and the special environmental factor involved makes the submarine threat one of the most difficult problems to counter. 2.3.3 Anti Air Warfare (AAW) Warships are vulnerable once detected at the open sea, therefore it exposed to be attacked, AAW in the maritime situation required fast reactionof its sensors and personnel, in order to counter the threat.   The purpose of AAW is defined as: Is the term used for the defence of friendly forces against the threat of aircraft and airborne weapon, whether launched from air, surface, or submarine platforms.   AAW is the maritime term for defensive counter air operations and is part of the joint air defence system.   AAW is based on the principle of defence in depth and layered defence, defeating air attacks at the maximum possible distance from maritime forces 2.3.4 Electronic Warfare (EW) In EW, an electromagnetic and acoustic spectrum is being exploited as to integrate to the various warfare areas, such as AAW, ASUW and ASW.   Warships and aircraft are equipped with a variety of systems that utiliseor exploit the electromagnetic and acoustic spectrums in order to give early information on enemy position [24] and activities. 2.4 RMN IN RELATION TO THE ENVIRONMENTAL ISSUES Being a small navy, the RMN needs to evolve to remain relevant.   It has to create a credible force encompassing an integrated system of ships, aircraft, submarines and well trained personnel, but resource are increasingly scarce.   To stay ahead, the RMN has to do more with less.   In other words, one of the RMN challenges is to stay ahead by achieving improvement through the application of creative and innovative solutions and making all round improvements continuously.   The other challenges are the need to adopt technological advancement, continuous upgrading of the existing fleet to ensure the highest state of readiness and effectiveness and achieving synergy in the future warfare scenario.   The procurement of new technologies and upgrading of its asset must parallel with the environmental friendly requirements. In 1994, the EarthCheck Global Standard was established by the travel and tourism industry to provide a mechanism for the promotion of environmentally sustainable tourism.   It is also demonstrating a commitment towards environmental and social responsibilities, better environmental risk management procedures and asset protection.   With the current awareness towards meeting the growing environmental requirement for compliance, RMN has started with KD LEKIU and KD SRI INDERASAKTI as a pioneer.   The bold action by the RMN is influences by following factors: The RMN ships will acknowledge as no different than other commercial vessels and thus its will bind to the same rules and regulations. Environmental issues are currently complex and need special attention and requiring effective and flexible long-range planning. It is difficult to forecast the environmental requirement due to ageing if warships in order to develop appropriate responses. The international community is increasingly applying a coordinated global approach to foster marine environmental issues.   Thus, the RMN should portray a good image in addressing the problem a pro-active way. Strict rules and regulations in controlling the marine pollution are now being implemented in coastal areas and also being expanded on the high seas. The RMN approaches toward environmental friendly warships is unable to meet the complex challenges of environmental compliance.   More strategic and forward-looking plan for future ships is to be implemented. The RMN approach toward environmental friendly warships is eventually costly and may sometimes endanger the health of service personnel as well as operational effectiveness. A better environmental compliant warship design is much more significant due to the good return of investment in operational and cost benefits.   It will not have to rely on shore support for waste management. Apart from these commitments, warships basically having the privileges of sovereign immunity and special exemption as discuss below. Complete exemption of warships and other ships owned or operated by a State and used only on government non-commercial service from the application of the convention so far as both main rules and enforcement provision are concerned. Having said that, the RMN has a strong sense of commitment in upholding the community values of Malaysia, thus naval operations are properly planned as to suite the environmental stewardship in order to preserve it for future generations and therefore,will give the RMN a fine record.   It appears that there were operational benefits from sound environmental practices and the RMN is slowly to adopt this concept.   2.5 CONCLUSION In conclusions Maritime Operations is a challenging business.   Having a vast area of operations with a multi faceted of the threat, the RMN continuously been challenged by the new development such as the rise of non-traditional maritime security issues and the complexity of maritime environmental issues.   Maritime operations, parallel with environmental issues will provide a better solution in managing the maritime security issues.   In another case, it will give some operational benefit to the RMN since every item onboard has been well maintained and the operational requirementsare easily tackled. Apart from having the special privileges and immunity of warships, the RMN should not take this advantage to take part as one of the environmental non-compliance conducts.   As to progress toward environmental stewardship, the RMN therefore should act like no different than international ocean shipping, which binds to the rules and regulations as to uphold the community values of Malaysia. CHAPTER 3 EXISTING MARITIME ENVIRONMENTAL ISSUES AND DEGREE OF RMN COMPLIANCE 3.1 INTRODUCTION The RMN warship is no different than other international oceans shipping all over the world; more or less it would contribute to the effect of the environmental issues.   Most studies have found that the international ocean shipping industry accounts for roughly three percent of global greenhouse gas emissions.   This means that if the ocean shipping industry were a country, it would rank seventh in the world in emissions.   Its shows that more or less ocean shipping industry contributed to environmental problems, hence warships are not excluded.   Even though warship has been thoroughly design, but it still contributes to some extend the environmental effect while doing their operational task.   As we go through our daily life, which is increasingly becoming fast paced and hectic, only a few of us take a time out to look around and notice the devastating effects of modem civilization on the environment.   The environment has to sustain not only the basic human needs for survival but also the conversion of raw materials into goods and services. Ensure continuous improvement in the productivity and quality of the environment while pursuing economic growth and human development. Ensure the highest commitment to environmental protection and accountability by all decision makers in the public and private sectors, resource users, non-governmental organisations and the general public, in formulating, planning and implementing their activities. Based on above principles in Malaysia National Policy on the Environment, the RMN is yet to adopt this principle officially because the negative aspect to the environment is very minute, but in a long term period the effect will slowly affect the environment, and this will de discuss further in following paragraph.   Therefore, planning and implementing activities from designing of warships to the way executioner part of the operations are to be monitored and suit to the highest commitment of environmental protection. Malaysia has a sound and viable National Environmental Policy and adequate legal regime to cope with challenges of the present day marine pollution issues   The protection of the marine environment and degree of the RMN compliance were based on Environmental Quality Act 1974, Merchant Shipping Ordinance 1952, Merchant Shipping Oil Pollution Act 1994, Exclusive Economic Zone Act 1984 and Fisheries Act 1985. 3.2 RELATED MARITIME ENVIRONMENTAL ISSUES Threats to the environment are an increasing concern for states, societies and the international community. In relations to naval operations, below are the related maritime environmental issue which more or less hascontributed to the emerging problems. 3.2.1 Water Pollution Water pollution may be less conspicuous than the solid waste pollution, but it is probably even more dangerous.   This is partly because a wider range of harmful chemicals falls in this category and partly because it is more mobile as compared to the solid waste materials.   With regard to marine environmental issues, liquid pollutants are generated from ships and offshore installations.   Liquids are simply dumped into the oceans without any treatment.   One of the most common liquid wastes is sewage.   In many cases sewage is discharged to the sea without any treatment, which will create disease producing bacteria thus the plant and animal life in it cannot survive and the water becomes anoxic or lifeless. 3.2.2 Air Pollution and Degradation of the Atmosphere Air pollution is one of the toxic forms that affect the environment.   Air, by far, is the most important aspect to human life.Air pollution and air quality has become a huge topic in the world today.   The air quality is different depending on your location where about.   For examples, Los Angeles is very smoggy and has poor quality versus the forests of Brazil that have very clean air, meanwhile Kuala Lumpur is experiencing seasonal haze from month of July to October every year.   Polluting the air with any kind of foreignmaterial such as carbon dioxide, sulphur dioxide, carbon mono-oxide, hydrogen sulphide, volatile organic compounds, chlorine, chloroform, chlorinedioxide and making environment dangerous to live for living species is called air pollution. Air pollution is actually the accumulation of any unsafe substances to the atmosphere, which causes the destructive of the environment, human health and the quality of life.   The increasing of shipping industries has increased in air pollution and even though ships are operating far from land, more or less it has contributed to the increase in the death rates resulting from various diseases caused by air pollution varying from breathing problem to lung cancer. Air pollution does not only affect people, but it also damages the whole ecological system in which plants and animals are harmed as well. Air pollution has reached such a critical stage where it affects the earths atmosphere as it lets in more harmful radiation from the sun. Consequently, our polluted atmosphere is becoming a better insulator, thus, preventing heat from escaping back into space. That is why there is a global rise in temperature, which scientists refer to as ‘global warming.   Pursuant to this rise i n temperature the world food supply and sea level will be affected, also there is the probability of the increase in the tropical disease. Air pollution also has a dramatic effect on natural resources.   Ecosystems such as forests, wetlands, coral reefs, and rivers perform many important services for Earths environment.   They enhance water and air quality, provide habitat for plants and animals, and provide food and medicines. Any or all of these ecosystem functions may be impaired or destroyed by air pollution.   Moreover, because of the complex relationships among the many types of organisms and ecosystems, environmental contamination may have far-reaching consequences that are not immediately obvious or that are difficult to predict. 3.2.3 Global Warming The excessive production of Carbon dioxide to the environment is one of the factors that have affected the ozone layer.Thus it willprevent some amount of solar energy from being radiated back to space. This phenomenon is known as the greenhouse effect which leads to global warming.Among the industrialized countries, USA, Russia, Japan and France are the largest contributors to this menace.USA alone accounts for 42% of the total carbon dioxide emission all over the wor1d.Most countries in this region like Malaysia and Indonesia are rapidly approaching the emission levels recorded.As of now a rise of average atmospheric temperature has been reported over the past 75 years and is likely to continue into the next century. Global warming has resulted in shrinking of glaciers and ice sheets; a rise of 6 to 37inches in the mean sea level is predicted by the year 2100.Low lying countries within this region such as Bangladesh and Indonesia risk getting submerged by the rising sea levels. Glob al warming will aggravate the water crisis in summer months. It would also lead to expansion of geographical range of tropical pests and will increase the chances of forest fires. 3.2.4 Ozone Depletions The stratospheric ozone layer existing between altitudes of 12 to 35 kilometres is considered as a protective shield or an umbrella for the earth because it prevents the ultraviolet rays from reaching the surface of the earth.In the absence of this layer, no life would be possible because the sun rays would raise the temperature of the lower atmosphere making the earth a blast furnace. The importance of the ozone layer came to light in 1985 when a hole was detected over Antarctica.Chloro Flouro Carbons or CFCs are the group of the gases, which are largely responsible for the depletion of the ozone layer. These synthetic chemicals are widely used as propellants in spray cans, air conditions and refrigerators. Thus CFCs in addition to carbon dioxide, methane and nitrous oxide are termed as greenhouse gases as they all contribute to the greenhouse effect. In addition to this, Ozone layer depletion has caused a definite rise in the cases of skin cancer it is estimated by the World Health Organization (WHO) that 12% decrease in the ozone layer would cause skin cancer in up to half a million people per annum. 3.2.5 Acid Rain Acid rain is the serious pollution hazard. It causes irreparable damage to agricultural crops, forests, aquatic life and even the human body. It corrodes buildings, pollutes the drinking water and degrades soil. Major sources of sulphur dioxide emission are thermal power plants, crude oil refineries and automobiles, which together account for 50% of the sulphur dioxide pollution.Rainwater of pH less than 5.6 is considered acidic. Emissions of waste gases from industries, vehicle exhausts and power generation are causes of rainwater acidity.When the pH levels of lakes and rivers fall below about 5.5, many species of fish will die, and this in turn is followed by changes in the ecosystem.Acid rain is corrosive to metals such as iron and zinc roof, marble and limestone.Low pH values have been attributed by an increased in industrial activity and large numbers of motor vehicles emitting considerable amounts of sulphur and nitrogen compounds into the atmosphere.Acid rain is detrimental to life and life-support systems. Acidity is measured by hydrogen ion concentration, designated as pH, and is measured on a scale of 1 to 14. A pH value below 7 is acidic, and above 7 is alkaline.Rain acidity in Peninsular Malaysia is on the rise and the number of areas affected by acid rain is growing. Studies by the Meteorological Service Department exposed that, to date the acid rain is becomingworrying environmental problem. 3.3 BINDING LAWS Most of the international environmental law is based on agreement or treaty.With regard to the protection of the marine environment, Malaysia adheres to a number of international conventions. The treaties are as follows: United Nations Convention on the Law of the Sea (UNCLOS), 1982. Maritime Pollutions Convention (MARPOL), 73/78. International Convention on Oil Pollution Preparedness, Response and Cooperation (OPRC), 1990. International Convention on Civil Liability for Oil Pollution Damage, 1992. International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage 1992. Treaties are made to be performed. ‘Pacta sunt servanda or the rule that treaties arebinding on the parties and must be performed in good faith is the fundamental principle of customary international law. This principle has been reaffirmed in Article 26 of theVienna Convention on the law of Treaties 1969, ‘Every treaty in force is binding uponthe parties to it and must be performed in good faith. Therefore, Malaysia is obliged to the binding laws and thus not excluding the RMN in this context. This paper will only discuss one domestic rule and twointernational treaties as to examine and relate the degree of the RMN compliance in environmental issues. 3.3.1 Exclusive Economic Zone (EEZ) Act 1984 The Exclusive Economic Zone Act 1984 is an important Malaysian statute devised to implement certain aspects of the UNCLOS 1982.Part IV of the EEZ Act deals with p Malaysia Maritime Environmental Issues and Its Impact Malaysia Maritime Environmental Issues and Its Impact CHAPTER 1 INTRODUCTION 1.1 BACKGROUND Seas and oceans traditionally used by us to have all the source of rich, opportunity and abundance. The vast area of it has given us the aspiration either to use or to abuse it.   Most of the countries in this world are connected with sea and ocean, which make the line of communication and transportation easily done through it.   Many years ago while air transportation is impossible, transportation through land could take a month to reach. Sea and ocean line was used heavily either for trade, communication or expanding the power beyond the borders.   The increasing awareness by us has changed the point of view that the feel of appreciation which not only in a sense of importance for economy and social, but also in a sense of security.   Maritime security and safety issues are major and hot topics nowadays.   It is spoken all over the world, especially in this modern and globalise era where crime has no longer a matter of a single country but a matter concerning everybody.   It is borderless and at any time can happen anywhere.   Because of the large maritime area, this crime is very difficult to contain particularly in the area where the enforcement is less due to lack of security assets.   This situation worries the country, especially those are depending directly to the sea as a source of development. Maritime threats have existed ever since commerce went to sea.   Now, its just in what capacity and in what dimension.   Threat to maritime in aspect of maritime security and safety can be from any kind such as piracy, sea robbery, human trafficking, smuggling and others, which cover up to sea pollution.   Malaysias total sea area of 614,159 square kilometres is almost twice its landmass and the size of itsExclusive Economic Zone(EEZ) alone is 453,186 square kilometres.   An estimated 70 percent of the population lives along 4,800 kilometres of coastline area, which have rich ecosystem and biodiversity.]With these unique backgrounds, it has offered tremendous economic value and prospects to Malaysia.   Major economic activities are offshore petroleum, marine transport, marine tourism, fisheries and aquaculture. As a maritime nation, Malaysia is a party to a number of international conventions dealing with marine pollution, which laid down important rules to be followed by s tate parties to prevent and control marine pollution.   Some reports have concluded that the quality of marine environment and life in our country is showing signs of decline.According to Oxford Dictionary (7th edition) environmental issues can best define with something connected to natural conditions that affect behaviour and development of something.   To be more precise, environmental issues are negative aspects of human activity on the biophysical environment.   Few examples of maritime environmental issues are conservation, environmental degradation, environmental health, nanotechnology, nuclear issues, water pollution, air pollution and resource depletion.   To explain further, the definitions of environmental issues in law perspective as follows: Any direct or indirect alteration of the physical, thermal, chemical, or biological properties of any part of the environment by discharging, emitting, or depositing environmentally hazardous substances, pollutants or wastes so as to affect any beneficial use adversely, to cause a condition which is hazardous or potentially hazardous to public health, safety, or welfare, or to animals, birds, wildlife, fish or aquatic life, or to plants or to cause a contravention of any condition, limitation or restriction. Royal Malaysian Navy (RMN) is one of the maritime agencies in Malaysia which one of the roles and functions is to safeguard our national interest.   Hence, theroles and functions are the bread and butter to the RMN, and of course it is not limiting the usage, freedom of manoeuvres in Malaysian waters for whatever reasons.   In connection to maritime environmental issues, the RMN has a strong sense of commitment in upholding the community values of Malaysia.   At the forefront of these values are respect for the environment and a growing need to ensure that naval operations are undertaken by sustainable methods and that the environment is preserved for future generations. 1.2 PROBLEM STATEMENT With the current capabilities and ageing of warships, RMN has a bigger issues to adhere to the rules and regulations with regards to environmental friendly and thus will affect the conduct of RMN Operations.Indeed there are inventions of new environmental friendly technologies and of course will increase operational efficiency, but due to the limited budget on national defence sector, RMN is to wisely maintain its own asset and at the same time parallel to environmental issue requirements. 1.3 OBJECTIVE S The objectives of this study as follows: To examine the relationship between Naval Operations and maritime environmental issues. To determine what is the negative factor contributes by RMN warships in relations to maritime environmental issues. To determine whether the capability of RMN in conducting operations isconstrainedby the current environmental policy and legislation. To suggest solutions towards the environment compliant warship without jeopardizing required operations. 1.4 SIGNIFICANCE OF THE STUDY RMN warships are not much different with any commercial vessel and thus should comply withenvironmental regulations such as the Environment Quality Act 1974.   Due to the integrity, RMN should set a very good example in complying not only to the act, but to adhere to the United Nations Convention on the Law of the Sea (UNCLOS) 1982 and a number of international maritime environmental conventions in order to portray a good image to the public.   RMN warships should be able to operate without restriction in ports or open seas.   Due to some intensive measures on environmental issues, there aresome restrictions and constraint on naval activity with regards to ships design and conduct of operations.   Hence, the study should be able to determine the best solution for win-win situation. 1.5 LITERATURE REVIEW The literature of the research mainly based on environmental thesis papers,which havebeen done by scholars as a reference.   Generally, the literature addresses Malaysias environmental qualities, environmental justice and common public attitudes towards the environment.   It is further discussed about policies, practices and Malaysias commitment to international agreements which to be scrutinized.   The literature as well as provides information with regards to consequences of the fast track style of development on our natural resources, health, quality of life and ecosystems. 1.6 LIMITATIONS OF THE STUDY The preparation of this research paper is based on the secondary data,mainly from books and other published articles.   Most of the material from military references are classified Restricted.   Therefore, limits the research on the subject matter. Time constrained is the biggest setback and hindered a more commendable study of the existing issues. 1.7 METHOD AND SOURCES The primary method will be through literature research.   Therefore, the sources will be published books and journal articles spanning the subject areas of Malaysia Environment Issues and RMN Operations.   Newspaper articles, speeches by relevant personalities and interviews will also be sought after.   Information will also be extracted from official governmental or organisation websites. 1.8 CHAPTER OUTLINE The paper will be organised into five chapters as follows: Chapter 1 : Introduction . This chapter is the introduction of the subject and layout of the paper. Chapter 2 : Maritime Operations .   This chapter will elaborate the concept and conduct of Naval Operations focusing on the RMN. Chapter 3 : Existing Maritime Environmental Issues and Degree of RMN Compliance .   This chapter examines a series of environmental issues, related to shipping design and operation.Its further discuss the degree of compliance for each issue, against existing environmental legislation and regulations. Chapter 4 : Impacts to RMN .   This chapter will discuss the impact on RMN current operations and to determine whether the capability of RMN in conducting operations is constrained by the current environmental policy and legislation. Chapter 5 : Conclusion .   This chapter includes a discussion on the possible outcomes and to suggest solutions towards an environment compliant warship without jeopardizing required operations. CHAPTER 2 MARITIME OPERATIONS 2.1 INTRODUCTION During the course of recorded history, mankind has perpetually looked towards the sea as a provider of nourishment, as a channel for trade and for the migration of people, culture or idea. The last three millennia has witnessed the development of maritime craft from simple design to the fully computerised ships of the modern day era.   In relation to safe guard maritime national security, warship has been designed and developed as a symbol of supremacy and struggle for control of the seas and trade influence in faraway lands.   Warships have been instruments of both good and evil and have influenced the evolution of mankind.   As a maritime nation, Malaysia is not excluded in enhancing and developing its naval capabilities.   Located at the crossroads of Southeast Asia and the sea are seen as an increasingly important factor in the economic and security aspect of this country. The Royal Malaysian Navy (RMN) started from humble beginnings with a rudimentary naval force of coal burning launches and small coastal patrol boats during the colonial time.   Today, the RMN fleet comprises an assortment of modern warships, submarines and naval helicopters armed with state of the art command, control, communication, computers and information (C4I) armed with long-range guided missiles and protected by the most modern electronic warfare systems.   This has completed the metamorphosis of RMN from the coastal Brown Water Navy into a Blue Water Navy, a modern armada. In order to parallel with its vision ‘To be a World Class Navy (Always Excellent), RMN have to be a committed organisation, competent, forward looking, strive for quality and always seek for continuous improvement in managing its own source and technology.   Presently, the roles of the RMN are two-fold; during wartime, the RMN is to ensure the maritime sovereignty of Malaysia while during peacetime, its role is to protect the nations maritime interest that included Malaysias offshore resources, especially oil and gas, shipping and fishing. Since environmental issues are a major challenge and concern throughout the world, the RMN has to develop its operations toward supporting the environmental friendly. 2.2 NAVAL OPERATIONS Naval operations will be the largest contributor toward the maritime environmental issues if it is not being tackled well.   To narrow down the scope of this research, the focus and discussions will be towards the RMN operations.   Every naval exercise always associated with the universal role known as ‘The Trinity of Naval Functions (Figure 2.1) namely military, constabulary and diplomacy.   The first role is the military which is to enforce of state sovereignty and defend the national jurisdictions in the sea by way of control and deterrence at sea.   Secondly is constabulary roles, the navy carried this to enforce the security and law to protect marine resources and the national marine wealth, to maintain order at sea and to support the national development.   The third role is diplomacy. Naval forces are the visible mobile and potent symbols of the nation state and such are the useful instruments of foreign policy.   These roles and functions are the bread and b utter to the RMN, and of course it is not limiting the usage, freedom of manoeuvres in Malaysian waters for whatever reasons. 2.3 MARITIME WARFARE AREAS Malaysia as a maritime nation is the facts that cant be argued about.   The sea area is larger than the land mass and a unique feature of being a country split by an ocean supporting the facts.   Malaysia is divided by the South China Sea into two main land masses namely the Peninsular Malaysia on the western side and Sabah and Sarawak on the eastern side.   These two land masses are being separated by more than 1000 kilometres of navigable waters.   Malaysia and the nations of the region are reliant on the sea for transportation; they draw greatly on the maritime environment for living and mineral resources.   Maritime forces have significant access and control in our region.Thus, Malaysia requires maritime forces able of curb the challenges of our strategic geographical conditions. The RMN is essentially responsible for protecting Malaysias maritime interest.   To meet these tasks, the RMN is provided with various assets ranging from old and obsolete patrol craft to the most modern and highly sophisticated state of the art frigates and corvettes capable of carrying out all the four dimensions of naval warfare, namely surface, sub-surface, air and electronic warfare. 2.3.1 Anti Surface Warfare ( ASu W ) The main dimension of Naval Operations is ASuW defined as follows: The actions necessary to detect, identify and counter an adversarys surface capability.   ASuW operations, which may include sea control and sea denial operations, disruption of Sea Lane of Communications (SLOCs), defence offriendly forces from surface attack, or a combination of all, seek toensure that the necessaryaction are conducted in a timely fashion, denying any adversary the ability to employ forces in an effective manner. Thus, freedom of manoeuvre and able to sustain long period of operations is the major requirements for the RMN warships. 2.3.2 Anti Submarine Warfare (ASW) In order to counter subsurface threat, RMN warships must be able to detect the enemy using any available sensors.   Therefore to locate a submarine requires a very hectic and thorough procedure which this will requires warships to stay longer at operational area.   The elements of ASW as follows: ASW comprises operations with the intention of denying the opponent the effective use of submarines.   The ASW protection of a force depends on defence in depth and close coordination between ships, helicopters, Maritime Patrol Aircraft (MPA), shore-based facilities and friendly submarines.   The complexity of such coordination and the special environmental factor involved makes the submarine threat one of the most difficult problems to counter. 2.3.3 Anti Air Warfare (AAW) Warships are vulnerable once detected at the open sea, therefore it exposed to be attacked, AAW in the maritime situation required fast reactionof its sensors and personnel, in order to counter the threat.   The purpose of AAW is defined as: Is the term used for the defence of friendly forces against the threat of aircraft and airborne weapon, whether launched from air, surface, or submarine platforms.   AAW is the maritime term for defensive counter air operations and is part of the joint air defence system.   AAW is based on the principle of defence in depth and layered defence, defeating air attacks at the maximum possible distance from maritime forces 2.3.4 Electronic Warfare (EW) In EW, an electromagnetic and acoustic spectrum is being exploited as to integrate to the various warfare areas, such as AAW, ASUW and ASW.   Warships and aircraft are equipped with a variety of systems that utiliseor exploit the electromagnetic and acoustic spectrums in order to give early information on enemy position [24] and activities. 2.4 RMN IN RELATION TO THE ENVIRONMENTAL ISSUES Being a small navy, the RMN needs to evolve to remain relevant.   It has to create a credible force encompassing an integrated system of ships, aircraft, submarines and well trained personnel, but resource are increasingly scarce.   To stay ahead, the RMN has to do more with less.   In other words, one of the RMN challenges is to stay ahead by achieving improvement through the application of creative and innovative solutions and making all round improvements continuously.   The other challenges are the need to adopt technological advancement, continuous upgrading of the existing fleet to ensure the highest state of readiness and effectiveness and achieving synergy in the future warfare scenario.   The procurement of new technologies and upgrading of its asset must parallel with the environmental friendly requirements. In 1994, the EarthCheck Global Standard was established by the travel and tourism industry to provide a mechanism for the promotion of environmentally sustainable tourism.   It is also demonstrating a commitment towards environmental and social responsibilities, better environmental risk management procedures and asset protection.   With the current awareness towards meeting the growing environmental requirement for compliance, RMN has started with KD LEKIU and KD SRI INDERASAKTI as a pioneer.   The bold action by the RMN is influences by following factors: The RMN ships will acknowledge as no different than other commercial vessels and thus its will bind to the same rules and regulations. Environmental issues are currently complex and need special attention and requiring effective and flexible long-range planning. It is difficult to forecast the environmental requirement due to ageing if warships in order to develop appropriate responses. The international community is increasingly applying a coordinated global approach to foster marine environmental issues.   Thus, the RMN should portray a good image in addressing the problem a pro-active way. Strict rules and regulations in controlling the marine pollution are now being implemented in coastal areas and also being expanded on the high seas. The RMN approaches toward environmental friendly warships is unable to meet the complex challenges of environmental compliance.   More strategic and forward-looking plan for future ships is to be implemented. The RMN approach toward environmental friendly warships is eventually costly and may sometimes endanger the health of service personnel as well as operational effectiveness. A better environmental compliant warship design is much more significant due to the good return of investment in operational and cost benefits.   It will not have to rely on shore support for waste management. Apart from these commitments, warships basically having the privileges of sovereign immunity and special exemption as discuss below. Complete exemption of warships and other ships owned or operated by a State and used only on government non-commercial service from the application of the convention so far as both main rules and enforcement provision are concerned. Having said that, the RMN has a strong sense of commitment in upholding the community values of Malaysia, thus naval operations are properly planned as to suite the environmental stewardship in order to preserve it for future generations and therefore,will give the RMN a fine record.   It appears that there were operational benefits from sound environmental practices and the RMN is slowly to adopt this concept.   2.5 CONCLUSION In conclusions Maritime Operations is a challenging business.   Having a vast area of operations with a multi faceted of the threat, the RMN continuously been challenged by the new development such as the rise of non-traditional maritime security issues and the complexity of maritime environmental issues.   Maritime operations, parallel with environmental issues will provide a better solution in managing the maritime security issues.   In another case, it will give some operational benefit to the RMN since every item onboard has been well maintained and the operational requirementsare easily tackled. Apart from having the special privileges and immunity of warships, the RMN should not take this advantage to take part as one of the environmental non-compliance conducts.   As to progress toward environmental stewardship, the RMN therefore should act like no different than international ocean shipping, which binds to the rules and regulations as to uphold the community values of Malaysia. CHAPTER 3 EXISTING MARITIME ENVIRONMENTAL ISSUES AND DEGREE OF RMN COMPLIANCE 3.1 INTRODUCTION The RMN warship is no different than other international oceans shipping all over the world; more or less it would contribute to the effect of the environmental issues.   Most studies have found that the international ocean shipping industry accounts for roughly three percent of global greenhouse gas emissions.   This means that if the ocean shipping industry were a country, it would rank seventh in the world in emissions.   Its shows that more or less ocean shipping industry contributed to environmental problems, hence warships are not excluded.   Even though warship has been thoroughly design, but it still contributes to some extend the environmental effect while doing their operational task.   As we go through our daily life, which is increasingly becoming fast paced and hectic, only a few of us take a time out to look around and notice the devastating effects of modem civilization on the environment.   The environment has to sustain not only the basic human needs for survival but also the conversion of raw materials into goods and services. Ensure continuous improvement in the productivity and quality of the environment while pursuing economic growth and human development. Ensure the highest commitment to environmental protection and accountability by all decision makers in the public and private sectors, resource users, non-governmental organisations and the general public, in formulating, planning and implementing their activities. Based on above principles in Malaysia National Policy on the Environment, the RMN is yet to adopt this principle officially because the negative aspect to the environment is very minute, but in a long term period the effect will slowly affect the environment, and this will de discuss further in following paragraph.   Therefore, planning and implementing activities from designing of warships to the way executioner part of the operations are to be monitored and suit to the highest commitment of environmental protection. Malaysia has a sound and viable National Environmental Policy and adequate legal regime to cope with challenges of the present day marine pollution issues   The protection of the marine environment and degree of the RMN compliance were based on Environmental Quality Act 1974, Merchant Shipping Ordinance 1952, Merchant Shipping Oil Pollution Act 1994, Exclusive Economic Zone Act 1984 and Fisheries Act 1985. 3.2 RELATED MARITIME ENVIRONMENTAL ISSUES Threats to the environment are an increasing concern for states, societies and the international community. In relations to naval operations, below are the related maritime environmental issue which more or less hascontributed to the emerging problems. 3.2.1 Water Pollution Water pollution may be less conspicuous than the solid waste pollution, but it is probably even more dangerous.   This is partly because a wider range of harmful chemicals falls in this category and partly because it is more mobile as compared to the solid waste materials.   With regard to marine environmental issues, liquid pollutants are generated from ships and offshore installations.   Liquids are simply dumped into the oceans without any treatment.   One of the most common liquid wastes is sewage.   In many cases sewage is discharged to the sea without any treatment, which will create disease producing bacteria thus the plant and animal life in it cannot survive and the water becomes anoxic or lifeless. 3.2.2 Air Pollution and Degradation of the Atmosphere Air pollution is one of the toxic forms that affect the environment.   Air, by far, is the most important aspect to human life.Air pollution and air quality has become a huge topic in the world today.   The air quality is different depending on your location where about.   For examples, Los Angeles is very smoggy and has poor quality versus the forests of Brazil that have very clean air, meanwhile Kuala Lumpur is experiencing seasonal haze from month of July to October every year.   Polluting the air with any kind of foreignmaterial such as carbon dioxide, sulphur dioxide, carbon mono-oxide, hydrogen sulphide, volatile organic compounds, chlorine, chloroform, chlorinedioxide and making environment dangerous to live for living species is called air pollution. Air pollution is actually the accumulation of any unsafe substances to the atmosphere, which causes the destructive of the environment, human health and the quality of life.   The increasing of shipping industries has increased in air pollution and even though ships are operating far from land, more or less it has contributed to the increase in the death rates resulting from various diseases caused by air pollution varying from breathing problem to lung cancer. Air pollution does not only affect people, but it also damages the whole ecological system in which plants and animals are harmed as well. Air pollution has reached such a critical stage where it affects the earths atmosphere as it lets in more harmful radiation from the sun. Consequently, our polluted atmosphere is becoming a better insulator, thus, preventing heat from escaping back into space. That is why there is a global rise in temperature, which scientists refer to as ‘global warming.   Pursuant to this rise i n temperature the world food supply and sea level will be affected, also there is the probability of the increase in the tropical disease. Air pollution also has a dramatic effect on natural resources.   Ecosystems such as forests, wetlands, coral reefs, and rivers perform many important services for Earths environment.   They enhance water and air quality, provide habitat for plants and animals, and provide food and medicines. Any or all of these ecosystem functions may be impaired or destroyed by air pollution.   Moreover, because of the complex relationships among the many types of organisms and ecosystems, environmental contamination may have far-reaching consequences that are not immediately obvious or that are difficult to predict. 3.2.3 Global Warming The excessive production of Carbon dioxide to the environment is one of the factors that have affected the ozone layer.Thus it willprevent some amount of solar energy from being radiated back to space. This phenomenon is known as the greenhouse effect which leads to global warming.Among the industrialized countries, USA, Russia, Japan and France are the largest contributors to this menace.USA alone accounts for 42% of the total carbon dioxide emission all over the wor1d.Most countries in this region like Malaysia and Indonesia are rapidly approaching the emission levels recorded.As of now a rise of average atmospheric temperature has been reported over the past 75 years and is likely to continue into the next century. Global warming has resulted in shrinking of glaciers and ice sheets; a rise of 6 to 37inches in the mean sea level is predicted by the year 2100.Low lying countries within this region such as Bangladesh and Indonesia risk getting submerged by the rising sea levels. Glob al warming will aggravate the water crisis in summer months. It would also lead to expansion of geographical range of tropical pests and will increase the chances of forest fires. 3.2.4 Ozone Depletions The stratospheric ozone layer existing between altitudes of 12 to 35 kilometres is considered as a protective shield or an umbrella for the earth because it prevents the ultraviolet rays from reaching the surface of the earth.In the absence of this layer, no life would be possible because the sun rays would raise the temperature of the lower atmosphere making the earth a blast furnace. The importance of the ozone layer came to light in 1985 when a hole was detected over Antarctica.Chloro Flouro Carbons or CFCs are the group of the gases, which are largely responsible for the depletion of the ozone layer. These synthetic chemicals are widely used as propellants in spray cans, air conditions and refrigerators. Thus CFCs in addition to carbon dioxide, methane and nitrous oxide are termed as greenhouse gases as they all contribute to the greenhouse effect. In addition to this, Ozone layer depletion has caused a definite rise in the cases of skin cancer it is estimated by the World Health Organization (WHO) that 12% decrease in the ozone layer would cause skin cancer in up to half a million people per annum. 3.2.5 Acid Rain Acid rain is the serious pollution hazard. It causes irreparable damage to agricultural crops, forests, aquatic life and even the human body. It corrodes buildings, pollutes the drinking water and degrades soil. Major sources of sulphur dioxide emission are thermal power plants, crude oil refineries and automobiles, which together account for 50% of the sulphur dioxide pollution.Rainwater of pH less than 5.6 is considered acidic. Emissions of waste gases from industries, vehicle exhausts and power generation are causes of rainwater acidity.When the pH levels of lakes and rivers fall below about 5.5, many species of fish will die, and this in turn is followed by changes in the ecosystem.Acid rain is corrosive to metals such as iron and zinc roof, marble and limestone.Low pH values have been attributed by an increased in industrial activity and large numbers of motor vehicles emitting considerable amounts of sulphur and nitrogen compounds into the atmosphere.Acid rain is detrimental to life and life-support systems. Acidity is measured by hydrogen ion concentration, designated as pH, and is measured on a scale of 1 to 14. A pH value below 7 is acidic, and above 7 is alkaline.Rain acidity in Peninsular Malaysia is on the rise and the number of areas affected by acid rain is growing. Studies by the Meteorological Service Department exposed that, to date the acid rain is becomingworrying environmental problem. 3.3 BINDING LAWS Most of the international environmental law is based on agreement or treaty.With regard to the protection of the marine environment, Malaysia adheres to a number of international conventions. The treaties are as follows: United Nations Convention on the Law of the Sea (UNCLOS), 1982. Maritime Pollutions Convention (MARPOL), 73/78. International Convention on Oil Pollution Preparedness, Response and Cooperation (OPRC), 1990. International Convention on Civil Liability for Oil Pollution Damage, 1992. International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage 1992. Treaties are made to be performed. ‘Pacta sunt servanda or the rule that treaties arebinding on the parties and must be performed in good faith is the fundamental principle of customary international law. This principle has been reaffirmed in Article 26 of theVienna Convention on the law of Treaties 1969, ‘Every treaty in force is binding uponthe parties to it and must be performed in good faith. Therefore, Malaysia is obliged to the binding laws and thus not excluding the RMN in this context.
